GENERAL TERMS AND CONDITIONS MY JUNIOR GMBH

1. Scope of application, customer information

(1) The following general terms and conditions (GTC) govern the contractual relationship between the My Junior GmbH, Am Parir 25, 52379 Langerwehe, Germany, and consumers who purchase goods via our shop.

(2) Terms and conditions that conflict with or deviate from our terms and conditions will not be recognised by us.

(3) The language of the contract is German.

2. Conclusion of Contract

(1) The conditions for our goods are subject to change and non-binding. Our presentation of goods on the internet does not constitute an offer, but rather a non-binding invitation for the customer to place an order. Technical or other changes in form, colour or weight remain reserved within reasonable limits.

(2) The online order merely constitutes an offer by the customer to the company. My Junior GmbH constitutes an offer to conclude a purchase contract. The confirmation of receipt of the order by e-mail does not represent acceptance, but merely informs the customer that their order has been received by the company. My Junior GmbH has been received. The acceptance of a telephone order does not constitute a binding acceptance by My Junior GmbH. The acceptance of the order takes place either by dispatch of the goods or, in the case of advance payment, by a payment request sent via email.

(3) The company My Junior The company GmbH is free to refuse online orders. The company My Junior GmbH is entitled to accept the contractual offer contained in the order within two weeks. 5. Retention of title

The item of purchase remains our property until full payment has been made.

6. Warranty

Statutory liability rights for defects apply to our goods. The statutory warranty rights in accordance with §434 BGB are not affected by the 2+1 warranty extension.

7. Limitation of Liability

We exclude liability for breaches of duty caused by slight negligence, provided these do not relate to essential contractual obligations, damages resulting from injury to life, limb or health, guarantees, or claims under the Product Liability Act (ProdHaftG). The same applies to breaches of duty by our vicarious agents and our legal representatives. Essential contractual obligations particularly include the obligation to deliver the item to you and to transfer ownership of it to you. Furthermore, we are obliged to provide you with the item free from material and legal defects.

8. Online dispute resolution

This platform is intended to give consumers the opportunity to settle disputes arising from online purchase contracts out of court.

9. Final Provisions

(1) Amendments or additions to these terms and conditions must be made in writing. This also applies to the waiver of this written form requirement.

(2) The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the country in which you have your habitual residence remain unaffected.

(3) If, at the time of concluding the contract, your place of residence or habitual abode was in Germany and you have either moved at the time legal action is brought or your whereabouts are unknown at that time, the place of jurisdiction for all disputes shall be the registered office of our company in Aachen.
